■ 利用規約

第1条（適用）
1. 本利用規約（以下「本規約」といいます）は、株式会社ハッピーマウンテン・カンパニー（以下「当社」といいます）が提供するアプリケーション「日々の綴り織」（以下「本サービス」といいます）の利用に関する条件を定めるものです。
2. 本サービスをご利用になった時点で、本規約に同意したものとみなします。
3. 本規約に同意いただけない場合は、本サービスのご利用をお断りします。

第2条（利用登録）
1. 本サービスの基本機能（日記の執筆・閲覧）は、当社への会員登録（メールアドレス・パスワード等によるユーザー登録をいいます。以下同じ。）なしでご利用いただけます。
2. 本サービスにおける有料機能のご購入は、App Store を通じた決済によります。ご購入手続きには、Apple が定める方法により、Apple ID（お客様が App Store で利用している Apple アカウント）による認証が必要です。
3. クラウドバックアップ機能（「静かな離れに置く」）をご利用の場合は、Apple ID によるサインインが必要です。
4. 前各項で利用する Apple ID は Apple が管理します。当社が収集する情報はニックネームに限定し、誕生年月その他の個人情報は取得しません。
5. 年齢確認（18歳以上であることの確認）は、課金手続き直前にダイアログで実施します。確認結果は保存しません。

第3条（アカウント管理）
1. Apple ID の管理は Apple のポリシーに従い、お客様ご自身の責任において行っていただきます。Apple ID にアクセスできなくなった場合、当社は個別の調査・復旧支援を行いません。
2. アカウントの第三者への譲渡・貸与はできません。
3. お客様の認証情報を通じて本サービス上で行われた一切の行為は、お客様ご自身によるものとみなします。

第4条（利用環境）
1. 本サービスはiOSアプリケーションとして提供します。対応するOSのバージョンはApp Storeのアプリ紹介ページにてご確認ください。
2. クラウドバックアップ機能（「静かな離れに置く」）の利用にはインターネット接続が必要です。接続できない場合、同期機能は動作しません。
3. 通信にかかる費用はお客様の負担となります。

第5条（有料機能）
1. 本サービスは、初めて「今日を紡ぐ」を押した日を1日目として30日間、無料で日記を執筆いただけます。31日目以降も執筆を続けるには「日々を綴り織る」のご購入が必要です。
2. 本サービスは以下の3種類の有料機能を提供します。各機能は完全に独立しており、それぞれ単独でご購入いただけます。
　- 日々を綴り織る（買切・一度限りの永続利用権）：無料期間終了後も日記・しおりを継続して利用できる権利
　- 静かな離れに置く（月額サブスクリプション・自動更新）：日記データのクラウドバックアップおよび復元機能
　- 作品を編纂する（都度課金・1回ごとの単発購入）：日記のPDF出力機能を1回実行できる権利
3. 各機能の価格はApp Store上およびアプリ内詳細ページにてご確認いただけます。当社はアプリ内に価格をハードコードしません。
4. 過去の日記の閲覧は、有料機能のご購入状況に関わらず制限しません。
5. 全てのお支払いはApp Store決済によります。当社は直接の代金受領を行いません。
6. 返金はApp Storeの規定に基づき、App Storeサポートへお問い合わせください。当社は直接の返金対応を行いません。

第6条（編纂機能について）
1. 「作品を編纂する」は、1回の購入につきPDF出力を1回実行できる権利（以下「編纂権」といいます）を付与する都度課金型の機能です。
2. 編纂権は1回分のみ保持できます。未使用の編纂権を保持している間は、追加購入できません。
3. 編纂権は、PDF生成が正常に完了した時点でのみ消費されます。PDF生成の途中でアプリが中断・終了した場合、編纂権は消費されず保持されます。
4. 保持中の編纂権は、アプリを再起動した後もそのまま継続して使用できます。
5. 編纂権の状態はお客様の端末内のローカル保存領域のみで管理されます。アプリを削除した場合、未使用・使用済みを問わず編纂権の状態は消失します。端末を変更した場合、編纂権の状態は新しい端末に引き継がれません。「購入情報の復元」操作を行っても、消費型商品（Consumable）である編纂権は復元されません。障害その他いかなる事由による消失についても、当社はその復元を保証しません。
6. 編纂権の消失について、当社は一切の復元義務および補償義務を負いません。
7. 前各項の定めにより編纂権を消失した場合、ご不満の際はApp Storeサポートへの返金申請をご検討ください。ただし、返金の可否はApp Storeの判断によります。

第7条（サブスクリプション機能について）
1. 「静かな離れに置く」は月額自動更新型のサブスクリプション機能です。App Storeの解約手続きを行わない限り、自動的に更新されます。
2. 解約はApp Storeのサブスクリプション管理画面からいつでも行えます。解約手続き後は、当該契約期間の末日をもってサービスの提供が終了します。
3. サブスクリプション解約後は、クラウド上の日記データの復元機能をご利用いただけません。
4. サブスクリプション解約後、クラウド上のデータは解約失効日時を起点として90日間保持されます。保持期間中は復元機能をご利用いただけません。
5. 保持期間（90日）以内に再度ご契約いただいた場合、クラウド上のデータから復元することができます。
6. 保持期間（90日）を経過したクラウド上のデータは削除対象となり、削除処理により削除されます。削除されたデータの復元はできません。
7. 複数の端末でご利用の場合、最後に「今日を紡ぐ」を押した端末のデータがクラウドに保管されます。書きかけの文章等は同期されません。複数端末利用によるデータの上書き・消失について、当社は一切の責任を負いません。
8. クラウド保存アカウントの削除（退会。アプリ内では「静かな離れに置くのをやめる」）は、サブスクリプション解約とは別の手続きです。退会手続きだけでは App Store 上の課金は自動的に停止しません。課金の停止は App Store のサブスクリプション管理画面から別途行ってください。
9. サブスクリプション解約後も、クラウド保存アカウントの削除（退会）は行えます。

第8条（データ管理）
1. お客様の日記データはお客様の端末（ローカル）に保存されます。サブスクリプション機能ご利用時は、「今日を紡ぐ」を押した時点でクラウドにも保存されます。
2. 書きかけの日記（下書き）はクラウドに保存されません。
3. アプリを削除・再インストールされた場合、端末上の日記データは消去されます。サブスクリプション機能をご契約中の場合はログイン後にクラウドからデータを復元できます。ご契約のない場合、データの復元はできません。
4. 再インストール後のクラウドデータ復元時には、クラウドに保存されたデータで端末のデータが書き換えられます。
5. クラウド保存アカウントの削除（退会。アプリ内では「静かな離れに置くのをやめる」）を実行した場合、クラウド上のデータおよび認証情報は即座に削除され、
復元はできません。退会後の削除取り消しはできません。なお、端末内に保存された日記・下書き・プロフィールは削除されません。
6. 「購入情報の復元」は App Store 上の課金状態を反映する機能であり、退会により削除されたクラウド上の日記データを復元するものではありません。

第9条（禁止事項）
お客様は、本サービスの利用にあたり以下の行為を行ってはなりません。
1. 法令または公序良俗に違反する行為
2. 犯罪行為または犯罪行為を助長する行為
3. 当社または第三者の知的財産権、プライバシー権、名誉権その他の権利を侵害する行為
4. 本サービスの運営を妨害する行為
5. 不正アクセスその他の不正な手段によるシステムへの侵入行為
6. 本サービスを商業目的で使用する行為（当社が別途許諾した場合を除く）
7. その他、当社が不適切と判断する行為

第10条（免責事項）
1. 当社は、本サービスがお客様の特定の目的に適合することを保証しません。
2. 当社は、以下の事由によってお客様に生じた損害について、一切の責任を負いません。
　- 端末の故障・紛失・盗難によるデータの消失
　- アプリの削除・再インストールによるデータの消失
　- 通信障害・ネットワーク障害によるデータの同期失敗または消失
　- PDF生成処理の失敗または中断による編纂権の消失
　- サービスの停止・中断・変更によるデータの消失
　- 天災その他当社の責めに帰さない事由による障害
　- 第三者による不正アクセスによるデータの消失または漏洩
3. 当社が本サービスの停止・終了を決定した場合、当社はその旨を事前にお客様へ通知します。ただし、緊急の場合はこの限りではありません。
4. 当社が損害賠償責任を負う場合であっても、当社の責任はお客様が当社に支払った直近1ヶ月分の利用料金を上限とします。

第11条（サービス内容の変更・停止）
1. 当社は、お客様への事前通知なくして本サービスの内容を変更することがあります。
2. 当社は、技術上・運用上の理由により、本サービスの全部または一部を一時的に停止することがあります。
3. 当社は、合理的な理由によって本サービスを終了する場合、終了日の30日前までにアプリ内またはその他の適切な方法でお客様に通知します。

第12条（利用規約の変更）
1. 当社は、必要と判断した場合、本規約を変更することがあります。
2. 本規約を変更する場合、変更後の規約の内容をアプリ内または当社ウェブサイトにて通知します。
3. 変更後の本規約の施行後に本サービスをご利用いただいた場合、変更後の規約に同意したものとみなします。

第13条（準拠法・管轄）
1. 本規約の解釈および適用は、日本法に準拠するものとします。
2. 本規約に関して生じた紛争については、広島地方裁判所を第一審の専属的合意管轄裁判所とします。

■ プライバシーポリシー

あなたの言葉は、あなたのものです。
本アプリは、ユーザーが紡いだ大切な記憶を尊重し、以下の通りプライバシーを保護します。

第1条（データ保存の原則）
本アプリで綴られた日記本文および画像は、原則としてユーザーの端末内（ローカルストレージ）にのみ保存されます。

第2条（サーバーを利用する機能）
以下の有料機能を利用する場合に限り、データが当社の管理するセキュアなサーバーへ送信・保持されます。
データバックアップ：ユーザーの明示的な同意に基づき、デバイスの紛失や故障に備え、日記データ一式を暗号化した状態でサーバーに保管します。

第3条（データの安全管理）
サーバーへ送信されるデータはすべて暗号化され、上記の目的以外（広告配信や第三者への提供など）に使用されることはありません。

第4条（権限の使用）
フォトライブラリへのアクセスは、日記への画像添付のためにのみ使用します。

第5条（データの削除）
クラウドバックアップとログイン用アカウントは、アプリ内「奥付」の「静かな離れに置くのをやめる」から削除できます。
サブスクリプションの解約後でも削除できます。端末内に保存された日記・下書き・プロフィールは、この操作では削除されません。

第5条の2（アプリ削除時のデータ消去）
本アプリを端末からアンインストールした場合、端末内に保存された日記・下書き・プロフィールはすべて消去されます。
クラウドバックアップ機能（「静かな離れに置く」）をご契約中の場合は、再インストール後にログインすることでクラウドからデータを復元できます。
それ以外の場合、消去されたデータの復元はできません。

第6条（未成年者のプライバシー）
本アプリは、18歳未満のユーザーから意図的に不必要な個人情報を収集することはありません。

■ Terms of Use

Article 1 (Application)
1. These Terms of Use (the “Terms”) set forth the conditions for use of the application “日々の綴り織” (the “Service”) provided by HAPPY MOUNTAIN COMPANY, K.K. (the “Company”).
2. By using the Service, you are deemed to have agreed to these Terms.
3. If you do not agree to these Terms, please refrain from using the Service.

Article 2 (Registration for Use)
1. The basic features of the Service (writing and viewing diary entries) can be used without registering as a member with the Company (i.e., without user registration via
email address, password, etc.; the same applies hereinafter).
2. Purchases of paid features within the Service are made through payment via the App Store. Such purchases require authentication via your Apple ID (the Apple account you use with the App Store), in accordance with the methods specified by Apple.
3. Signing in with your Apple ID is required to use the cloud backup feature（「静かな離れに置く」）.
4. The Apple ID used in the preceding paragraphs is managed by Apple. The information collected by the Company is limited to your nickname; the Company does not collect your date of birth or any other personal information.
5. Age verification (confirming that you are 18 years of age or older) is performed via a dialog immediately before the purchase process. The result of this confirmation is not saved.

Article 3 (Account Management)
1. Management of your Apple ID is subject to Apple’s policies and is your own responsibility. If you lose access to your Apple ID, the Company will not conduct individual investigations or provide recovery assistance.
2. You may not transfer or lend your account to any third party.
3. Any actions taken within the Service using your authentication credentials shall be deemed to have been taken by you.

Article 4 (Operating Environment)
1. The Service is provided as an iOS application. Please refer to the App Store product page for supported OS versions.
2. An internet connection is required to use the cloud backup feature （「静かな離れに置く」）. If no connection is available, the synchronization feature will not function.
3. Any communication charges incurred are borne by the user.

Article 5 (Paid Features)
1. The Service offers a free 30-day writing period, beginning on the day you first tap「今日を紡ぐ」. From day 31 onward, a purchase of 「日々を綴り織る」 is required to
continue writing.
2. The Service offers the following three independent paid features, each of which may be purchased separately:
　- 日々を綴り織る — One-time purchase (permanent, non-consumable): grants the right to continue using the diary and bookmark features after the free period ends.
　- 静かな離れに置く — Monthly auto-renewing subscription: provides cloud backup and restoration of diary data.
　- 作品を編纂する — Pay-per-use (consumable): grants the right to perform one PDF export of diary entries.
3. Prices for each feature can be confirmed on the App Store and on the in-app detail pages. The Company does not hard-code prices within the App.
4. Access to view past diary entries is not restricted regardless of your purchase status for any paid feature.
5. All payments are made via the App Store. The Company does not directly receive any payment.
6. Refunds are subject to App Store policy; please contact App Store Support. The Company does not process refunds directly.

Article 6 (Regarding the Compilation Feature)
1. 「作品を編纂する」 is a pay-per-use feature that grants, for each purchase, the right to perform one PDF export of diary entries (the “Compilation Right”).
2. Only one Compilation Right may be held at a time. While an unused Compilation Right is held, no additional purchase of the same type can be made.
3. The Compilation Right is consumed only at the moment PDF generation completes successfully. If the App is interrupted or terminated during PDF generation, the Compilation Right is not consumed and remains held.
4. A held Compilation Right remains usable even after restarting the App.
5. The status of the Compilation Right is managed solely within local storage on your device. If you delete the App, the status of the Compilation Right — whether used or unused — will be lost. If you change devices, the status of the Compilation Right will not carry over to the new device. Performing “Restore Purchases” will not restore the Compilation Right, as it is a consumable product. The Company does not guarantee restoration of the Compilation Right lost for any reason, including malfunction.
6. The Company bears no obligation to restore or compensate for the loss of the Compilation Right.
7. If you lose the Compilation Right as set forth in the preceding paragraphs and are dissatisfied as a result, you may consider applying for a refund through App Store Support; however, whether a refund is granted is at the App Store’s discretion.

Article 7 (Regarding the Subscription Feature)
1. 「静かな離れに置く」 is a monthly auto-renewing subscription feature. Unless cancelled through the App Store, it renews automatically.
2. You may cancel at any time via the App Store’s subscription management screen. After cancellation, the Service will continue to be provided until the end of the then-current billing period.
3. After cancelling your subscription, you will no longer be able to use the cloud data restoration feature.
4. After cancelling your subscription, your cloud data will be retained for 90 days, beginning from the date the subscription expires. During this retention period, the restoration feature will not be available to you.
5. If you re-subscribe within the 90-day retention period, you can restore your data from the cloud.
6. Cloud data for which the 90-day retention period has elapsed will be subject to deletion and will be deleted through the deletion process. Deleted data cannot be restored.
7. If you use multiple devices, the data from the device on which 「今日を紡ぐ」 was most recently tapped is the data stored in the cloud. Entries in progress (drafts) are not synchronized. The Company bears no responsibility for any overwriting or loss of data resulting from use of multiple devices.
8. Deletion of your cloud storage account (i.e., withdrawal; referred to within the App as 「静かな離れに置くのをやめる」) is a separate procedure from cancelling your subscription. Withdrawal alone does not automatically stop billing on the App Store. To stop billing, please separately cancel your subscription via the App Store’s subscription management screen.
9. You may delete your cloud storage account (withdraw) even after cancelling your subscription.

Article 8 (Data Management)
1. Your diary data is stored locally on your device. While you are using the subscription feature, your data is also saved to the cloud at the moment you tap 「今日を紡ぐ」.
2. Diary entries in progress (drafts) are not saved to the cloud.
3. If you delete and reinstall the App, the diary data stored on your device will be erased. If you have an active subscription, you can restore your data from the cloud after signing in. If you do not have an active subscription, the data cannot be restored.
4. When cloud data is restored after reinstallation, the data on your device will be overwritten with the data stored in the cloud.
5. If you delete your cloud storage account (withdraw; referred to within the App as 「静かな離れに置くのをやめる」), your cloud data and authentication information will be deleted immediately and cannot be restored. Withdrawal cannot be undone once completed. Note that diary entries, drafts, and your profile stored on your device are not deleted by this operation.
6. “Restore Purchases” reflects your purchase status on the App Store; it does not restore cloud diary data that has been deleted as a result of withdrawal.

Article 9 (Prohibited Conduct)
When using the Service, you must not engage in any of the following:
1. Acts that violate laws or public order and morals.
2. Criminal acts or acts that encourage criminal conduct.
3. Acts that infringe upon the intellectual property rights, privacy rights, reputation, or other rights of the Company or third parties.
4. Acts that interfere with the operation of the Service.
5. Unauthorized access or other improper means of intrusion into the system.
6. Use of the Service for commercial purposes (except where separately authorized by the Company).
7. Any other conduct that the Company deems inappropriate.

Article 10 (Disclaimer)
1. The Company does not guarantee that the Service is suitable for any particular purpose of yours.
2. The Company bears no responsibility for any damages arising from the following:
　- Loss of data due to device malfunction, loss, or theft.
　- Loss of data due to deletion or reinstallation of the App.
　- Failure or loss of data synchronization due to communication or network failure.
　- Loss of the Compilation Right due to failure or interruption of the PDF generation process.
　- Loss of data due to suspension, interruption, or modification of the Service.
　- Failures due to natural disasters or other causes not attributable to the Company.
　- Loss or leakage of data due to unauthorized access by third parties.
3. If the Company decides to suspend or terminate the Service, the Company will notify you in advance, except in urgent cases.
4. Even where the Company is liable for damages, the Company’s liability shall be limited to the amount of fees you paid to the Company in the most recent one-month period.

Article 11 (Changes to and Suspension of the Service)
1. The Company may change the content of the Service without prior notice to you.
2. The Company may temporarily suspend all or part of the Service for technical or operational reasons.
3. If the Company terminates the Service for a reasonable cause, the Company will notify you within the App or by other appropriate means at least 30 days prior to the termination date.

Article 12 (Changes to These Terms)
1. The Company may revise these Terms when it deems necessary.
2. When revising these Terms, the Company will notify you of the revised content within the App or on the Company’s website.
3. If you use the Service after the revised Terms take effect, you are deemed to have agreed to the revised Terms.

Article 13 (Governing Law and Jurisdiction)
1. These Terms shall be governed by and construed in accordance with the laws of Japan.
2. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the Hiroshima District Court as the court of first instance.

■ Privacy Policy

Your words belong to you.
This App respects the precious memories that users have woven, and protects your privacy as follows.

Article 1 (Principle of Data Storage)
The diary text and images recorded in this App are, in principle, stored only locally on your device (local storage).

Article 2 (Features That Use a Server)
Only when you use the following paid feature is data transmitted to and retained on the Company’s managed, secure server.
Data Backup: Based on your explicit consent, and in preparation for loss or malfunction of your device, the entirety of your diary data is stored on the server in encrypted form.

Article 3 (Secure Management of Data)
All data transmitted to the server is encrypted and is not used for any purpose other than those described above (such as advertising or provision to third parties).

Article 4 (Use of Permissions)
Access to your photo library is used solely for attaching images to diary entries.

Article 5 (Deletion of Data)
Your cloud backup and login account can be deleted via 「静かな離れに置くのをやめる」 within the App’s colophon page. This can be done even after cancelling your subscription. Diary entries, drafts, and your profile stored on your device are not deleted by this operation.

Article 5-2 (Erasure of Data Upon Uninstallation)
If you uninstall this App from your device, all diary entries, drafts, and profile data stored on your device will be erased. If you are subscribed to the cloud backup feature
（「静かな離れに置く」）, you can restore your data from the cloud by signing in after reinstalling. Otherwise, erased data cannot be restored.

Article 6 (Privacy of Minors)
This App does not knowingly collect unnecessary personal information from users under the age of 18.
