利用規約（会社共通・総則） / Terms of Service
第1条（適用） / Article 1 (Application)
本規約は、株式会社ハッピーマウンテン・カンパニー（以下「当社」）が提供するすべてのアプリケーション（以下「本サービス」）の利用に関する共通の条件を定めるものです。ユーザーは本サービスを利用することにより、本規約に同意したものとみなします。なお、個々のアプリケーションに固有の条件（データの取り扱い、課金方式等）については、各アプリケーションの個別規約に定めるものとし、本規約と個別規約の内容が異なる場合は、個別規約の定めが優先します。
These Terms set forth the common conditions for the use of all applications (the "Service") provided by HAPPY MOUNTAIN COMPANY, K.K. (the "Company"). By using the Service, users are deemed to have agreed to these Terms. Conditions specific to individual applications (such as data handling and billing methods) are set forth in the individual terms of each application. Where the individual terms differ from these Terms, the individual terms shall prevail.
第2条（アカウント登録の要否） / Article 2 (Necessity of Account Registration)
本サービスのご利用にあたり、当社への会員登録（メールアドレス・パスワード等によるユーザー登録）が必要かどうかは、アプリケーションごとに異なります。詳細は各アプリケーションの個別規約をご確認ください。
Whether member registration with the Company (user registration using an email address, password, etc.) is required to use the Service varies by application. Please refer to the individual terms of each application for details.
第3条（有料機能のご購入） / Article 3 (Purchase of Paid Features)
有料機能のご購入手続きは、App Store または Google Play の決済システムによります。購入に関する条件（価格、支払時期、返金の可否等）は、各アプリケーションの個別規約および特定商取引法に基づく表記をご確認ください。
Purchases of paid features are processed through the payment systems of the App Store or Google Play. Please refer to the individual terms of each application and the notation based on the Act on Specified Commercial Transactions for conditions relating to purchases (price, timing of payment, availability of refunds, etc.).
第4条（禁止事項） / Article 4 (Prohibited Acts)
ユーザーは、本サービスの利用にあたり、以下の行為を行ってはなりません。
１．本サービスの逆コンパイル、リバースエンジニアリング、その他の解析行為
２．本サービスを利用した法令または公序良俗に反する行為
３．本サービスのサーバーまたはネットワークの運営を妨害する行為
４．その他、当社が不適切と判断する行為
Users shall not engage in any of the following acts when using the Service:
1. Decompiling, reverse engineering, or otherwise analyzing the Service;
2. Acts that violate laws or public order and morals using the Service;
3. Acts that interfere with the operation of the Service's servers or network;
4. Any other act that the Company deems inappropriate.
第5条（知的財産権） / Article 5 (Intellectual Property Rights)
本サービスに関する著作権その他の知的財産権は、当社または正当な権利を有する第三者に帰属します。
Copyrights and other intellectual property rights relating to the Service belong to the Company or to third parties who legitimately hold such rights.
第6条（免責事項） / Article 6 (Disclaimer)
当社は、本サービスの利用により生じた損害について、当社の故意または重過失による場合を除き、責任を負いません。ユーザーの通信環境または端末環境に起因する不具合について、当社は責任を負いません。
The Company shall not be liable for any damages arising from the use of the Service, except where caused by the Company's willful misconduct or gross negligence. The Company shall not be liable for malfunctions caused by the user's communication environment or device environment.
第7条（サービスの変更・終了） / Article 7 (Changes to or Termination of the Service)
当社は、事前の通知なく本サービスの内容を変更し、または提供を終了することがあります。ただし、サービスを終了する場合であって、ユーザーが有料で購入した機能等に重大な影響が生じるときは、合理的な期間を設けて事前に告知するよう努めます。
The Company may change the content of the Service or terminate its provision without prior notice. However, where terminating the Service would have a material impact on features that users have purchased for a fee, the Company will endeavor to provide advance notice within a reasonable period.
第8条（規約の変更） / Article 8 (Changes to These Terms)
当社は、必要に応じて本規約を変更することがあります。変更後の規約は、アプリケーション内またはウェブサイト上に掲示した時点で効力を生じます。重要な変更を行う場合には、アプリケーション内での通知その他の方法によりお知らせします。
The Company may change these Terms as necessary. The revised Terms shall take effect upon being posted within the application or on the website. Where a material change is made, the Company will provide notice within the application or by other means.
第9条（準拠法・管轄） / Article 9 (Governing Law and Jurisdiction)
本規約は日本法に準拠します。本サービスに関して紛争が生じた場合は、広島地方裁判所を第一審の専属的合意管轄裁判所とします。
These Terms shall be governed by the laws of Japan. Any disputes arising in connection with the Service shall be subject to the exclusive jurisdiction of the Hiroshima District Court as the court of first instance.
